These Terms of Use (“Terms”) are an obligation binding you, hereby referred to as the “Purchaser” or “Buyer” or  “Entity” and Targheeb Educational Consultancy Services Private Ltd hereby referred to as “Targheeb’’ or “us” or “our” or “we”.

Intellectual Property (IP) hereby refers to the protection of creations of the mind, which have both a moral and a commercial value. Patents: New, non-obvious, industrially applicable inventions; Trademarks Signs or symbols to identify goods and services; Topography of semi-conductor products – Original layout design; Copyright – Original work of authorship; Neighboring rights – Original work of authorship; Protection against unfair competition – All the above.

Products hereby refers to all Intellectual Property (IP) such as educational Resources covered under copyright Nice Classification (2018) Class 11, which hereby refers to all printed matter; photographs and images; instructional; and teaching materials; or courses or training material.

Services hereby refers to services provided online such as online interactive live courses, training and others covered under copyright Nice Classification (2018) Class 41, which hereby refers to education; providing training; and cultural activities. If you represent the Purchaser or Buyer or Entity whether it be a school, institute or any other similar operation, Targheeb would require an authorization from the Purchaser or Buyers or Entity for you to undertake any teaching or learning activities conducted by Targheeb.

Thus, Targeeb’s “Terms” govern the use of Targheeb’s Products and Services, not limited to but including all educational Resources such as printed matter; photographs and images; instructional; and teaching materials; or courses or training material that are in the form of worksheets, lesson plans, e-books, training handouts, articles, data,  graphics, and any other information that falls under Intellectual Property (IP), that we provide you through our website.

www.targheeb.com or through electronic means such as emails, logins to the website, file-transfer, Dropbox etc. and/or any Service that we may provide via internet or mobile applications.

The “Purchaser or Buyer” or “Entity” hereby agree to the following:

1. Usage: Using Targheeb’s Resources or Services in any way indicates that you have read and accepted the Terms and other policies set-out online prior to purchase.
   
   
2. Changes: Targheeb will have the right to alter or modify, update, remove, suspend or discontinue any of the resources, material, curriculum, course outlines, classroom format, instructional strategy or teaching methods, or timetable offered online with or without notifying you. However, if you are a student and possess a valid account, you would remain our valued customer and we would inform you via your registered email of any modifications to these Terms as they may necessitate in order to maintain transparency.
   
   
3. General use: A student should be above 18 years of age to create an account. Minors would require a parent or legal guardian’s consent and written undertaking to participate online.
   
   
4. Resources: On these said Terms, we are granting you personal, non-exclusive, revocable and non-transferable access to download, print and use the Resources as follows (the “Permitted Purpose”):

   (i) if you are using the Resources as an individual for personal use such as home-schooling your child(ren) the Resources are licensed to you for your personal, non-commercial  use only;

   (ii) if you are representing a school, institute or any other similar operation, Targheeb would require   a  written authorization from the Purchaser or Buyer or entity as mentioned above.

   (iii)  you have no rights in our Resources (Products) or Services (Online Courses) or any part thereof and you may not modify, edit, copy, reproduce, redistribute, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Intellectual Property that is purchased or granted free of cost.

   (iv)  if you are at any time not in any need of the Resources copyrighted to Targheeb you agree to delete or destroy the Resources ensuring that they are not accessible to a third party.

5. Mobile applications: Our website is also accessible via other electronic modes and mediums such as mobile applications, and tablets such as iPads.

   We do not guarantee that the mobile application or other electronic devices such as tablets support our live interactive online courses and is strongly discouraged from use during the online courses.

7. Accounts; password restricted services: You do not require an account or password to visit the website and view the Products and Services we offer. However, if you wish to enroll your details for periodic updates and announcements, you would be entitled to them. Enrollment for Courses, however, parents or guardians would require you to enroll student(s) information online prior to processing the payment. Parents and guardians will also be required to submit a copy of the student’s birth certificate or passport for verification by admin prior to commencement of the courses.
   
   
8. Payments: You hereby agree to pay all applicable fees related to your use of the Products and Services. All fees are based on Services purchased, regardless of actual usage. (For Course payments, please see Fee Based Course Policy online ww.teduresourcesglobale.com). All course payments should be renewed by you. You may not have access to a course unless it is renewed online.

   All global fees excluding Sri Lanka will be paid in equivalent or in US Dollars. Fee payments for Sri Lanka should be remitted to “Targheeb“,  Amana Bank, Colombo 3, Sri Lanka.

9. Electronic communications: By using any of our Products or Services, you consent to receiving electronic communications from us. These electronic communications may include updates on new Products and Services, and other information concerning or related to the Products and Services offered by us. Furthermore, these electronic communications would be part of your commitment to avail our Products and Services. Therefore, you agree that any notices, agreements, disclosures or other communications (electronic mail or public announcements) that we send you electronically will satisfy any legal communication requirements by you.
   
10. Privacy policy: Targheeb honors your privacy and will ensure to keep all personal or student information provided in strict confidence.
11. Submissions: In order for you to download or submit student work, Targheeb would enroll student(s) to their respective course(s) and you hereby agree that you are solely responsible for access and submissions and that any such submission is considered both non-confidential and non-proprietary. Further, you will not be able to edit or delete a submission once it has been submitted.
12. Unauthorized activities: To be clear, you are strictly not authorized to record, screen print, or indulge in any unethical and unprofessional activities such as sharing or posting any of Targheeb’s activities or resources in any public or social media accounts such as Facebook, Twitter, Instagram, What’s App, email groups, etc. We authorize  you to use Targheeb’s Products and Services only for Personal, Permitted Purposes above mentioned. Any other use of the Products or Services beyond the Permitted Purposes will constitute unauthorized use of Targheeb’s Products and Services.

    Unauthorized use of the Products or Services may result in violation of various local and international copyright laws. You are not authorized to use the Products or Services in any of the following ways (these are examples only and the list below is not an exhaustive list):

• In a manner that modifies, publicly displays, publicly performs, reproduces or distributes any of the Products or Services for any commercial purpose that competes with our Products and Services in any way;
• In a manner that violates any local, national, foreign, or international statute, regulation, rule, order, treaty, or other law;
• To impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity;
• To interfere with or disrupt the Products and Services or servers or networks connected to any of the Services;
• To use any data mining, robots, or similar data gathering or extraction methods in connection with the Products or Services;
• To attempt to gain unauthorized access to any portion of the Products or Services, accounts, computer systems, or networks connected to this Targheeb’s website www.targheeb.com, whether through hacking, password mining, or any other means.

12. Proprietary rights: Targheeb’s Products and Services include registered and unregistered trademarks that belong to Targheeb Educational Consultancy Services (Pvt) Ltd. Other trademarks, names and logos found in the Products and Services would also be the property of their respective owners.

    Unless otherwise specified in these Terms, all Products and Services that include Intellectual Property such as Resources   including the arrangement of them in the Services are the sole property of Targheeb. All rights not expressly granted herein are reserved. Except as otherwise required or limited by applicable law, any reproduction, distribution, modification, re-transmission, or publication of any copyrighted material is strictly prohibited without the express written consent of the copyright owner.

13. Disclaimer: Targheeb’s Products and Services are provided “AS IS” without perfection, and the risk as to the use of the Products and Services is with you. We hereby expressly disclaim all warranties of any kind (express, implied or statutory) with respect to Targheeb’s Products and Services, which include but is not limited to, any implied or statutory warranties of merchantability, fitness for a particular use or purpose, title, and non-infringement of intellectual property rights.

    Without limiting the generality of the foregoing, we make no warranty that the Products and Services will meet your requirements, that Products and Services will be error-free, uninterrupted, timely, secure or that defects in the Products or Services or Material or Resources or Courses will be corrected. We make no warranty as to the results that may be obtained from the use of the Products or Services, or as the accuracy or reliability of any information obtained through the use of the Products or Services and not responsible for the products, services, actions or failure to act of any third party.  No advice or information, whether oral or written obtained by you through use of the services or from us or our affiliated associates if any or websites shall create any warranty. We disclaim all equitable indemnities.

    We think direct communication resolves most issues – if we feel that you are not complying with these Terms of Use, we will tell you. We will even provide you with recommended necessary corrective action(s) because we value your relationship with us.

14. All transactions related to International Visa and Master Card online payment via the gateway will be under the Targheeb Educational Consultancy LLC, Sharjah Media City, Sharjah United Arab Emirates.

    All Intellectual property related matters and Sri Lankan currency related payments to Education consultancy Services (Pvt) Ltd. will be governed by the Sri Lankan Laws.
